The General Conditions of Contract regulate the distance selling relationship between MARABANS SL and the user or client, in accordance with the legal stipulations, in particular, Law 7/1998, of 13 April, on General Conditions of Contract, Law 3/2014, of 27 March, which amends the revised text of the General Law for the Defence of Consumers and Users, Organic Law 3/2018, of 5 December, on the Protection of Personal Data and guarantee of digital rights, General Data Protection Regulation (EU) 2016/679, Law 7/1996, of 15 January, on the Regulation of Retail Trade, and Law 34/2002 of 11 July, on Information Society Services and Electronic Commerce.

MARABANS SL reserves the right to make any modifications it deems appropriate, without prior notice, to the General Conditions. Such modifications may be made, through its websites, by any means admissible by law and shall be binding during the time they are published on the website and until they are not validly modified by subsequent modifications. However, MARABANS SL reserves the right to apply, in certain cases, Specific Contracting Conditions in preference to these General Conditions when it deems appropriate, announcing them in due time and form.

The purpose of the website is: Sale of coffees, teas.

The duration of the contract shall be linked to the delivery of the product without prejudice to the right of withdrawal.

As a user or client, you expressly declare that you know, understand and accept the conditions of use and these general contracting conditions. Likewise, you declare that you are of legal age and have the necessary legal capacity to access the MARABANS SL websites and contract through them.

You can register as a user of the website to make the purchase online in the corresponding section of the website. In accordance with applicable and current legislation on data protection, MARABANS SL informs users that personal data collected during the registration process and subsequent purchase, will be incorporated into the processing system owned by MARABANS SL, in order to process such actions by the user and manage subsequent actions arising from them.

Your data will be kept for the period of time strictly necessary to fulfil the purposes set out above, unless there is a legal obligation to keep them.

We inform you that the legal basis for the processing of your data is the correct execution of the contract between the parties and consent.

In accordance with the rights conferred by current data protection legislation, you may exercise your rights of access, rectification, limitation of processing, deletion, portability and opposition to the processing of your personal data, as well as the consent given for the processing thereof, by sending your request to the address mentioned above or to the following e-mail address tiendaonline@marabans.com.

You may address your complaint to the competent supervisory authority.

During the purchase process you must identify yourself with the user name and password provided. These data will not be made public. You are responsible for the confidential and responsible treatment of the identity and password obtained during registration as a customer, and may not pass them on to anyone else. You can modify the information registered at any time, in your customer area. In this same section you will have access to a history of your orders, this is only a consultation section but its management is allowed, and the user can delete those records that he/she considers it is not necessary to view. 

Once the purchase process has been completed, the customer will receive a confirmation of the purchase by e-mail. It is essential that during the purchase process the user indicates a valid email address. If you do not receive the confirmation within 24 hours from the completion of the order, please contact MARABANS SL by telephone customer service 971599110 or by e-mail tiendaonline@marabans.com.

Upon receipt of the product at the delivery address provided, the customer will receive an invoice or a copy of the order.

2.- OFFER AND VALIDITY

In the case of a product on offer, the offer price and the validity of the offer shall always be indicated next to the essential characteristics of the product.

In compliance with current regulations MARABANS SL offers information on all items on sale, their characteristics and prices. However, MARABANS SL reserves the right to withdraw, replace or change the products offered through its website, by simply changing the content of the same. In this way, the products offered at any given time on the website will be governed by the General Conditions of Contract in force in each case. Likewise, the company shall have the right to stop offering, without prior notice and at any time, access to the aforementioned products.

3.- ESSENTIAL CHARACTERISTICS OF THE PRODUCTS

The products offered in our online shop, incorporate a photograph and the essential characteristics of the same, this is the information obtained from the manufacturer itself. The colour of the product, observable in the photograph, is not binding. The characteristics identify the product

4.- GUARANTEES

In the case of perishable products, if you receive them in poor condition or out of date, please contact tiendaonline@marabans.com. It is essential to follow the storage instructions given on the packaging itself and to observe the expiry date, in any case keeping the proof of purchase.

5.- PRICES

All products indicate the selling price in Euros and include Value Added Tax (VAT).

If any other tax is applicable, this would be indicated (IGIC or IPSI).

6.- SHIPPING COSTS, TRANSPORT AND DELIVERY TIME

MARABANS SL informs that it will ship in Peninsula and Balearic Islands. No shipments to the Canary Islands/Ceuta and Melilla.

Please note that the shipping costs will vary depending on the destination and are specified below:

No shipments to Formentera, Ceuta, Melilla, Canary Islands and remote islands in Europe.

If the order does not reach the minimum amount for free shipping, the corresponding shipping cost will be applied depending on area and method of delivery.

The availability of products offered by MARABANS SL may vary depending on customer demand. Although MARABANS SL updates the stock periodically, the product requested by the customer may be out of stock at that time. In case of non-execution due to unavailability, MARABANS SL will notify the client by e-mail as soon as it becomes aware of this situation. The period of this communication shall in no case exceed a maximum period of 30 days. MARABANS SL will be able to give the double option of: To supply the client without price increase, a product of similar characteristics or of superior quality, or except for reasons justified and demonstrable by MARABANS SL within this same period to pay the sums paid for the cancelled order.

7.- FORMS OF PAYMENT

The customer may pay the amount of his order in any of the following ways. You must indicate your choice during the purchase process:

- Credit card VISA or MASTERCARD

All operations involving the transmission of personal or banking data are carried out using a secure environment, a server based on standard SSL (Secure Sockets Layer) security technology. All information you transmit to us travels encrypted over the network.

Likewise, your credit card details are entered directly on the bank's website, at the bank's POS (Point of Sale Terminal) and are not entered or registered on any MARABANS SL server. 

When paying by VISA or MASTERCARD, you will always be asked for the following information: the card number, the expiry date, and a Validation Code that matches the last three digits of the number printed in italics on the back of your VISA or MASTERCARD, thus offering more guarantees about the security of the transaction.

This payment method is valid only on the website.

When the amount of a purchase has been fraudulently or improperly charged using the number of a payment card, the cardholder may demand the immediate cancellation of the charge. In such a case, the corresponding debit and credit entries shall be made as soon as possible on the accounts of the supplier and the cardholder. 

However, if the purchase had actually been made by the cardholder and the demand for refund was not the result of having exercised the right of withdrawal or termination and, therefore, had unduly demanded the cancellation of the corresponding charge, the cardholder shall be liable to MARABANS SL for compensation for damages caused as a result of such cancellation.

8.- Promotions and discounts

Unless expressly stated otherwise, promotions, discount codes and offers cannot be combined with each other and are not compatible with other promotions in force.
The company reserves the right to modify or cancel promotions at any time.

9.- RIGHT OF WITHDRAWAL

The purchaser shall have a period of fourteen (14) calendar days to withdraw, starting from the day on which the customer receives the product, without penalty and without stating the reasons.

According to the provisions of article 103 of Law 3/2014, of 27 March, which amends the revised text of the General Law for the Defence of Consumers and Users, supplies of services or goods made according to the consumer's specifications or clearly personalised, or which, by their nature, cannot be returned or are likely to deteriorate or expire quickly, are exempt from withdrawal.

10.- THE RETURN

The customer must return or deliver the product directly to MARABANS SL, to the address SESTADORS 23, 07458 CA'N PICAFORT (ILLES BALEARS) or to the carrier that MARABANS SL has available for this purpose, without any undue delay, and in any case within a maximum period of fourteen (14) calendar days from receipt of the order. The deadline will be understood to have been met if the customer returns the product before the end of the period.

MARABANS SL will bear the transport costs of returning the product and will send a paid return label from DHL Parcel or In Post. The buyer must drop off the package at any DHL Parcel or In Post pack point. Once received in the same condition as it was sent, the corresponding refund will be generated.  

MARABANS SL informs that in case you do not wish to return the products through any of the free options available, the customer will be responsible for the return costs. Please note that if you decide to return the items to us freight collect we will be entitled to charge for any costs we may incur.

11.- REIMBURSEMENT OF PAYMENT

The reimbursement of the amounts received by the customer shall be made using the same means of payment used by the customer, unless otherwise provided.

MARABANS SL may withhold the refund until it has received the product, or until the customer provides proof of return of the product, depending on which condition is met first. 

12.- RETURN OF THE DEFECTIVE PRODUCT

In the event that the product is not in good condition and the causes attributable to this are not the result of the customer, the customer will have the right to return the product, informing MARABANS SL of the reason for return through any of the means provided in these conditions of contract, and at no cost to the customer. This return due to a defect or poor condition of the product will not be considered a right of withdrawal.

MARABANS SL undertakes to assume the cost of the return and to return the product for a new one in accordance with the conditions accepted at the time of sale.

If the customer wishes to make a complaint, the establishment of MARABANS SL is located at SESTADORS 23, 07458 CA'N PICAFORT (ILLES BALEARS) or by e-mail tiendaonline@marabans.com.

13.- ERROR THAT THE ARTICLE MAY SUFFER AND OUT OF STOCK

The availability of products offered by MARABANS SL may vary depending on customer demand. Although MARABANS SL updates the stock periodically, the product requested by the customer may be out of stock at that time. In case of non-execution due to unavailability, MARABANS SL will notify the client by e-mail or phone call as soon as it becomes aware of this situation. The period of this communication will not exceed in any case the maximum period of thirty (30) days. MARABANS SL will be able to give double option of: To supply the client without price increase, a product of similar characteristics or of superior quality, or except for reasons justified and demonstrable by MARABANS SL, within this same period, to pay the sums paid for the cancelled order.

14.- JURISDICTION

Likewise, MARABANS SL reserves the right to bring any civil or criminal action it deems appropriate for improper use of its website and content or for failure to comply with these conditions.

The relationship between the user and the provider shall be governed by the regulations in force and applicable in Spanish territory. Should any dispute arise, the parties may submit their conflicts to arbitration or go to ordinary jurisdiction in compliance with the rules on jurisdiction and competence in this regard. MARABANS SL is domiciled in Illes Balears, Spain.
